Don't Be Bullied by the U.S. Census
We the people... wait, does that say We the lawyers, or maybe We the judges, no no We the bureaucrats, perhaps We the NWO? I'm so confused, what does it say :( Oh, we the PEOPLE! Yay, what did I win? 60 days in jail you say? A $100 fine? Pretty small price to pay. Wait, what? Remove my right to buy weapons? When did that occur? So, let me get this straight: you can violate all my rights to privacy, which are listed, in no less than 5 Amendments to the constitution; and if I uphold my right to privacy, strictly against the government, you throw me in jail and fine me and take away my constitutional right to bear arms? What blue planet did I fall off of?
Silly, ain't it? But, let's get on with the discussion. So the U.S. Census is coming to town. Maybe some of you have already gotten it. There is a big controversy over it. What is that controversy? Well apparently, instead of a census, the census bureau is taking it upon themselves to ask you very personal and extremely private questions that you should never tell anyone in government. People argue that the questions would not be held against you, however in the past they have been used to round up the Japanese and send them to internment camps and other horrible things, that were personally identified by the U.S. Census. If someone ever said it cannot be used against you, they are either trying to willfully mislead you, or they are oblivious of any recent history.
What are You Constitutionally Mandated to Say?
The article discussing the census is found in the very first article of the constitution. You cannot get any more important that that. The U.S. Constitution requires that a census of the entire population, citizens and noncitizens alike, be made every ten years (Article I, Section 2, Clause 3). The 14th amendment to the Constitution directs that the census will be used to determine the number of members of the U.S. House of Representatives from each state. The census is conducted by the U.S. Census Bureau, an agency established in 1899 within the U.S. Commerce Department.
Let's see that Article 1, section 2, clause 3:
Clause 3: Representatives and direct Taxes shall be apportioned among the several States which may be included within this Union, according to their respective Numbers, which shall be determined by adding to the whole Number of free Persons, including those bound to Service for a Term of Years, and excluding Indians not taxed, three fifths of all other Persons [oh my God, negro slaves]. The actual Enumeration [that means head count] shall be made within three Years after the first Meeting of the Congress of the United States, and within every subsequent Term of ten Years, in such Manner as they shall by Law direct. The Number of Representatives shall not exceed one for every thirty Thousand, but each State shall have at Least one Representative; and until such enumeration shall be made, the State of New Hampshire shall be entitled to chuse three, Massachusetts eight, Rhode-Island and Providence Plantations one, Connecticut five, New-York six, New Jersey four, Pennsylvania eight, Delaware one, Maryland six, Virginia ten, North Carolina five, South Carolina five, and Georgia three.
Let's look at the 14th amendment:
Section. 2. Representatives shall be apportioned among the several States according to their respective numbers, counting the whole number of persons in each State, excluding Indians not taxed. But when the right to vote at any election for the choice of electors for President and Vice President of the United States, Representatives in Congress, the Executive and Judicial officers of a State, or the members of the Legislature thereof, is denied to any of the male inhabitants of such State, being twenty-one years of age, and citizens of the United States, or in any way abridged, except for participation in rebellion, or other crime, the basis of representation therein shall be reduced in the proportion which the number of such male citizens shall bear to the whole number of male citizens twenty-one years of age in such State. Now I already did a piece on your right to privacy, against the government. So clearly the census is used solely to count people for representation of the house of representatives. It is not supposed to be used to ask you what time you go to work. [actual question] The constitution was written to give us the limitations of the government, not the powers of government. The governments, up until that time in history, assumed all powers. Given this assumption, the founding white fathers decided that the constitution was expressly prohibit the government from that very assumption of power, except for what was expressly given in the constitution. If anyone ever tells you otherwise, they have no business opening their mouth.
What does all this mean? As a U.S. citizen, by your birth right, you are to give just an accounting of what grown adults live in your house. In plain English, how many, what number, adults live in your house. That does not include names, things, money, medical information, family history, financial information, social information.
The debate goes on because there are two obscure cases that had nothing to do with the census, that said "no one should question the power of congress." Well, I just told you the constitution expressly prohibits the power of congress. The two cannot be right. Neither case were a supreme court case though. So for someone to even site the cases is dumb. The cases had nothing to do with the census and they were not supreme court cases.
Why has there not been a supreme court case? Because the census bureau is afraid that if they were to actually prosecute someone that refused to fill out the census, that there would be a massive backlash and participation in the census would immediately fall to like 10% participation. As it stands now, there is nowhere near 100% participation. To my knowledge, no one has been prosecuted for not filling out the Census.
I am not trying to get you or anyone else to disobey the law. I am not giving you legal advice. This article is for entertainment purposes only. I ain't one to gossip, so you didn't hear this from me. BUT...
I'm sure you're asking am I going to fill out the census. Well, I've never ever received a census to fill out. Besides, the government is about to get more information out of me than that measly census anyway, because I'm applying for a Washington job. I expect I'll get a full cavity search. I expect they'll go over my finances with a fine tooth comb. I expect no part of my privacy will be left undisturbed. *sigh* But, that is the price you have to pay with them right? No more income tax, at the expense of giving up all your constitutional rights. LOL Luckily, they'll never see this, because no one knows my real name, and the picture is fake. I'm actually a blond haired, blue-eyed, fat, Asian, Brazilian, chick from Mongolia. Yeah, that's the ticket.
